Under this treaty:
- Only bets on “defined sporting events with verifiable results” are permitted
- All other product types — including prediction markets on politics, crypto, weather, economics — are illegal by default
- The GGL stated that prediction market formats are “particularly susceptible to manipulation, as they are often based on unclear, subjective, or controllable events”
Criminal Law Implications
This is not just a regulatory matter. Under German law:
- Organizing, promoting, or participating in illegal gambling is a criminal offence
- The Federal Court of Justice (BGH) has consistently ruled that contracts based on illegal gambling are void and unenforceable
- There is no licensing pathway for prediction markets in Germany currently
BaFin and Crypto Regulation
BaFin (Germany’s Federal Financial Supervisory Authority) has not directly acted against Polymarket — the action was taken by the GGL. However:
- BaFin is the designated national regulator under MiCAR (EU Markets in Crypto-Assets Regulation)
- Under the KMAG law (published December 2024), any crypto exchange operating without a BaFin licence is illegal in Germany as of January 1, 2026
- BaFin has adopted a proactive “name-and-warn” strategy, publicly flagging firms suspected of violating MiCAR
Some legal scholars have suggested that prediction markets could theoretically operate in Germany if reframed as financial derivatives under BaFin supervision rather than gambling products. However, no platform has pursued this path, and there’s no indication BaFin would welcome it.
